Introduction

This Privacy Notice applies to Constellation Mutual.com and Constellation’s and its subsidiaries’ or businesses operating under the Constellation portfolio of brands, including, but not limited to MMIC Insurance, Inc., UMIA Insurance, Inc., Arkansas Mutual Insurance Company, and InsureCAREteams™, a product of MMIC Insurance, Inc., and UMIA Insurance, Inc., (collectively, “Constellation,” “us,” “our,” or “we”) websites, portals, products and services that collect data and display these terms (collectively, “Sites”). This Privacy Notice does not apply to Constellation Sites that do not display or link to this statement or that have their own Privacy Notice.

We understand that you are aware of and care about your personal privacy and we take that seriously. This Privacy Notice describes Constellation’s policies and practices for collection and use of your personal information.

We understand that you are aware of and care about your personal privacy and we take that seriously. This Privacy Notice describes Constellation’s policies and practices for collection and use of your personal information.

We do not knowingly offer or sell products or services to children. Our Site is not intended for anyone under 13 years of age.

We do not offer or sell products or services outside the United States.

By using this Site, you agree to the terms and conditions contained in this Privacy Notice and the Terms of Use and/or any other agreements that we might have with you. If you do not agree to any of these terms and conditions, you should not use this Site or any Constellation or Constellation Members’ Site or any Constellation products and services.

HOW WE COLLECT AND USE YOUR INFORMATION

Constellation collects and processes your personal information to provide you with purchased products and services. We use this information to administer your insurance policy to manage, investigate, or process claims, to communicate with you about your policy, and to provide other policy or product related information.

Information you provide
1. Coverage and Quotes
When you complete an insurance application or request a quote, information requested may include, but not be limited to:

  • Full name
  • Business address
  • Personal address
  • E-mail address
  • Telephone number
  • Social security number
  • Date of Birth
  • Licensing or regulatory board actions
  • Professional license information
  • National Provider Identity (NPI) number

We use your information is used to:

  • Provide a quote for an insurance product
  • Properly underwrite insurance products
  • Arrange and administer insurance
  • Deliver risk services
  • Investigate, defend and administer claim services
  • Respond to your questions
  • Notify you about available products or services

2. Educational program registration
Constellation provides ‘in-person’ and web based educational programs. When you register for a Constellation-sponsored educational program we ask for your information on the registration form that may include but not be limited to the following:

  • First and last name
  • Employer or policy information
  • Role or title
  • Email address
  • Telephone number
  • Address
  • Meal preference

We retain this registration information for three years and use it to notify you of future programs and events. For educational programs offering Continuing Medical Educational (CME) credits, retention is adjusted to comply with the Accreditation Council for Continuing Medical Education guidance.

3. Correspondence
If you correspond with us by email, postal service or other forms of delivery, we may retain this correspondence and the information contained in it to respond to your inquiry, notify you of Constellation services, and to keep a record of your request or report.

We may retain the email address and other contact information you provide when creating an account or when submitting an application for coverage. We will retain your username and email address when you create an account on the customer portal and forum.

Should you agree to receive electronic delivery of policy documents and information about your coverage, you can change your delivery preference on the Constellation customer portal or by email or phone at the contacts below.

We use your contact information, including your email address to send you communications such as newsletters, announcements about products and services and educational program announcements. You can unsubscribe to email communications at any time.

4. Website chat services
Any discussions, questions or information communicated via a website chat may be retained by the organization we have enlisted to provide this service. Constellation may also save the content of chat messages as a record of your question or request.

5. Customer Forums
If you are invited to participate in a Constellation customer forum, any information posted on the Customer Forum is visible to all participants and not confidential. The user policy outlining use and expectations is available on the forum websites.

6. Payment card information
If you choose to purchase products and services from Constellation, payment card information is provided directly by users via the Constellation website, into the PCI/DSS-compliant payment processing service to which Constellation subscribes.

Constellation does not, itself, process or store your payment card number. Constellation does not view, collect or retain your payment card information.

7. Banking information
If you choose to utilize automatic bill payments, you will be directed to a secure banking service Constellation partners with for this service.

Constellation does view, collect or retain your bank account information.

Information we get from third parties
We may collect information necessary for products and services from your insurance agent, your employer or another individual if you have authorized them to provide it to us. This information may be collected using various means including, in writing, in person, by telephone, by email or through other electronic means.

We may also collect your personal information from publicly available sources or third parties who compile information from publicly available sources or from other organizations if you have permitted them to share your information.

Constellation is not responsible for the privacy practices of any third party from whom we gather information.

If you chose not to provide your information
Without your personal information, we will not be able to provide insurance coverage, administer your policy, answer questions or process a claim.

USE OF THE CONSTELLATION WEBSITE

Should you choose to access content or use portions of the Constellation website, personal information may be collected as described here.

Information you provide
We collect personal information you choose to share with us. For example, when you:

  • Request a quote for insurance
  • Complete an application
  • Submit information about a potential claim
  • Register for the customer portal and forum
  • Communicate with us through this Site
  • View content on the member Site

We do not require you to register or provide this information to view our public website content.

In addition to the information you provide, we also collect information about individuals who visit Constellation websites that link to this notice.

Personal information collected
In addition to the information you provide, we also collect information about individuals who visit Constellation websites in the following manner.

1. Website analytics
Like other websites, we collect certain information automatically when you access our Site. Constellation uses a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses ‘cookies’, to help us analyze Site use. The information generated by the cookie about your use of the Site will be transmitted to and stored by Google on servers in the United States. We receive a report with aggregate information that we use to evaluate Site use and activity. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. By using our Site, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

We may use information collected about your location to combine with other data for purposes of analyzing the combined data and providing feedback and internal reporting.

Constellation utilizes a marketing platform that places a cookie when a user interacts with a marketing communication, such as clicking a registration link in a Constellation email. We use this information to evaluate customer interest and the effectiveness of marketing campaigns.

2. Cookies and device identifiers
Cookies are small files that are placed on your computer’s hard drive by your Internet browser. A device identifier is a unique identifier assigned to the device that you use to access the Site. We use cookies and device identifiers to identify visitors who have used our Services and website before.

Constellation may track aggregate data about users who log into the secure portal section of our Site and their navigation patterns. Constellation does not track customers when they cross to third party websites and does not provide information for third party advertising to them.

Types of cookies placed on the Constellation sites may include:

  • Necessary: This type of cookie is necessary for the website to function properly. These cookies can only be disabled through your browser settings.
  • Performance: These cookies are used for website analytical purposes. We utilize this type of cookie to understand website performance and to enhance our content.

Relation to third party websites
When using this Website, you may be directed to or select a link to other websites for making payments to utilize website functionality or for social media plugins. These websites may use their own cookies. Constellation does not have control over the placement of cookies by other websites you visit, even if you are directed to them from our Website.

We do not control, nor are we responsible for, the privacy practices or content of third party websites and applications, including social media sites linked to on the Constellation sites.

Cookies can be disabled or removed by tools that are available in most commercial browsers. The preferences for each browser you use will need to be set separately and different browsers offer different functionality and options.

Do not track
Constellation identifies visitors to the website when they enter through a marketing communication and when users log into the customer portal. Constellation does not track customers when they cross to third party websites and does not provide targeting advertising and does not respond to Do Not Track signals.

HOW WE SHARE YOUR INFORMATION

Constellation does not sell your personal information. We may disclose your information as described here.
We may make your personal information available to third parties as permitted by applicable law to administer our insurance policies or when required by law. We may provide your personal information to:

  • Contractors or third parties providing services to us related to the administration of insurance policies, such as: distributors, brokers, agents, claims and loss assessors, claims managers, and insurance reference bureaus.
  • Related bodies and corporate companies in the Constellation, Inc. insurance group that provide administrative services, process insurance policies, administer claims and submit required regulatory reporting.
  • Third party administrators, emergency providers, repairers and suppliers, and investigators for the purpose of processing and administering your claims.
  • Governmental authorities, law enforcement agencies and dispute resolution bodies and agencies

In addition, we may disclose information where we think it is necessary to investigate or prevent an actual or suspected crime or injury to ourselves or others, if required by law, or in response to a request from law enforcement authorities or other government officials.

During the normal course of our business, Constellation may sell or purchase assets. If another entity acquires, or seeks to acquire, Constellation or any of its assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should a sale or transfer occur, we will use reasonable efforts to require that the transferee use personally identifiable information provided through our Site in a manner that is consistent with this privacy statement.

SECURITY OF YOUR INFORMATION

We maintain administrative, technical, and physical safeguards and require our vendors to meet acceptable privacy and security standards. We restrict access to your personal information to those workforce members who need to know your information in order to provide services to you. We provide ongoing training and regularly test our security technology.

DATA RETENTION

Constellation will retain personal information about you for the period necessary to fulfill the purposes for which is was collected through the course of your business relationship and then as necessary to meet applicable law.

CORRECTING YOUR INFORMATION

We take steps to ensure that your personal information is accurate, complete and up-to-date.
For us to process requests for corrections or information on your personal information, you will be asked to provide additional information, that may include but not be limited to:

  • Full name
  • Policy number
  • Details about the request
  • If the request is about another person, a written authorization from that individual.
